Terms of Service

1. Introduction and Acceptance of Terms
These Terms of Service (“Terms”) govern the provision of garden and related outdoor maintenance services by Maple Leaf Garden Care Ltd. (“Company,” “we,” “us,” or “our”) to customers (“Client,” “you,” or “your”). By requesting, booking, authorizing, or accepting any services from Maple Leaf Garden Care Ltd., you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you must not use or accept our services. These Terms apply to all service requests, estimates, quotations, work orders, and service agreements unless otherwise agreed in writing by Maple Leaf Garden Care Ltd.
2. Scope of Services
Maple Leaf Garden Care Ltd. provides garden and landscape maintenance services, which may include, without limitation, the following:
- Garden bed design and planting
- Lawn care and edging
- Seasonal cleanups and leaf removal
- Shrub and hedge trimming
- Mulch and soil installation
- Irrigation system checks and adjustments
- Weed control and garden maintenance
Any services not expressly listed above are outside the scope of these Terms unless separately confirmed in writing by Maple Leaf Garden Care Ltd. We may refuse or limit services where site conditions, weather, safety concerns, legal restrictions, or equipment limitations make performance impractical or unsafe.
Estimates are based on the information available at the time of quotation and may change if site conditions, access, materials, or requested work differ from the original assumptions.
3. User Obligations and Responsibilities
You agree to provide accurate and complete information relating to your property, access conditions, service expectations, and any known hazards. You are responsible for ensuring that the service location is reasonably accessible and safe for our personnel, tools, and equipment.
- Remove or secure pets, children, vehicles, fragile items, irrigation components, ornaments, and other obstructions before service begins.
- Disclose underground, concealed, or sensitive conditions, including wiring, irrigation lines, drainage systems, utilities, buried items, or unstable surfaces.
- Obtain any necessary permissions, consents, condominium approvals, municipal permits, or other authorizations required for the services.
- Ensure that property boundaries and areas to be serviced are clearly identified.
- Comply with all applicable laws, municipal bylaws, and building or community rules relating to the property.
You acknowledge that failure to meet these obligations may result in delays, additional charges, partial performance, suspension of work, or cancellation of services.
4. Payment Terms and Conditions
Unless otherwise stated in writing, all fees are quoted in Canadian dollars (CAD) and are subject to applicable taxes, including GST/HST where required by law. Payment terms may vary depending on the type and size of the project.
- Invoices are due upon receipt unless a different due date is stated on the invoice or quotation.
- For recurring or larger projects, Maple Leaf Garden Care Ltd. may require a deposit, progress payments, or full advance payment.
- Materials, special-order items, disposal fees, permit fees, parking charges, and subcontractor costs may be charged in addition to labor fees unless expressly included in the quote.
- Late payments may be subject to interest at the maximum rate permitted by applicable law, as well as reasonable collection costs.
- We reserve the right to suspend or withhold services for overdue accounts.
If a quotation is based on hourly rates, the final invoice will reflect actual time spent, including reasonable travel, setup, cleanup, and equipment usage, where applicable and disclosed in advance or in the service agreement.
5. Cancellation and Refund Policy
To cancel or reschedule a service, you must provide reasonable notice by phone or email. Where possible, we ask that cancellations be made at least 24 hours before the scheduled appointment. For larger or custom projects, longer notice may be required as set out in the applicable quotation or service agreement.
- Late cancellations, missed appointments, or failure to provide site access may result in a cancellation fee or minimum service charge.
- Deposits for custom, scheduled, or special-order work may be non-refundable to the extent permitted by law, particularly where materials have been purchased, labor has been reserved, or work has already commenced.
- Refunds, if any, are evaluated on a case-by-case basis and may be limited to services not yet performed and materials not yet ordered or used.
- No refund is provided for completed services that were performed in accordance with the agreed scope, except where required by applicable law.
Where weather conditions, safety concerns, or circumstances beyond our control prevent performance, Maple Leaf Garden Care Ltd. may reschedule the service or issue a credit or refund at our discretion, subject to applicable law and any written agreement.
6. Liability Limitations
To the fullest extent permitted by applicable law, Maple Leaf Garden Care Ltd., including its directors, officers, employees, agents, and contractors, shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of use, loss of enjoyment, loss of profit, or property damage arising from conditions beyond our reasonable control.
Without limiting the foregoing, we are not responsible for:
- Pre-existing property damage, hidden defects, or subsurface conditions;
- Damage caused by undisclosed utilities, irrigation lines, drainage systems, cables, pipes, or buried objects;
- Plant failure due to weather, pests, disease, soil conditions, watering practices, or improper third-party care;
- Delays or failures caused by weather, supply shortages, access issues, municipal restrictions, or force majeure events;
- Damage resulting from instructions given by the Client that conflict with our professional recommendations.
Where liability cannot be excluded under applicable law, Maple Leaf Garden Care Ltd.’s total aggregate liability for any claim arising out of or relating to the services shall be limited to the amount paid by the Client for the specific service giving rise to the claim, except where otherwise required by law.
Nothing in these Terms excludes or limits any liability that cannot be excluded under applicable Canadian law.
7. Intellectual Property Rights
All materials created, developed, or provided by Maple Leaf Garden Care Ltd. in connection with the services, including quotations, proposals, work descriptions, plans, designs, schedules, reports, photographs, and other documentation, remain the intellectual property of Maple Leaf Garden Care Ltd. unless ownership is expressly transferred in writing.
You are granted a limited, non-exclusive, non-transferable license to use any deliverables provided solely for your personal or internal property-use purposes in connection with the relevant property. You may not reproduce, distribute, modify, sell, license, or commercially exploit our materials without our prior written consent.
We may, where permitted by law and subject to privacy obligations, take photographs of completed work for record-keeping, quality control, training, and promotional purposes. Any use of identifiable images of your property will be handled in accordance with applicable privacy laws and any written agreement between the parties.
8. Data Protection and Privacy
Maple Leaf Garden Care Ltd. collects, uses, and discloses personal information only as necessary to provide services, manage client relationships, process payments, respond to inquiries, maintain records, improve operations, comply with legal obligations, and otherwise operate our business.
We handle personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) where applicable, and any applicable provincial privacy legislation.
- We may collect contact details, billing information, service history, property access instructions, and communication records.
- We use reasonable administrative, technical, and physical safeguards to protect personal information.
- We do not sell personal information.
- We may disclose information to service providers, payment processors, contractors, insurers, or authorities where necessary or legally required.
By using our services, you consent to our collection, use, and disclosure of your personal information as described in these Terms and in any separate privacy policy we may provide. If you believe any personal information we hold is inaccurate or wish to make a privacy-related request, you may contact us using the information below.
9. Force Majeure
Maple Leaf Garden Care Ltd. shall not be liable for any delay or failure in performance due to events beyond our reasonable control, including but not limited to severe weather, floods, fires, storms, power outages, labor disputes, supply shortages, disease outbreaks, public emergencies, governmental actions, transportation disruptions, and acts of God.
Where a force majeure event occurs, our obligations will be suspended for the duration of the event, and we may reschedule, modify, or cancel services as reasonably necessary.
10. Changes to Terms
Maple Leaf Garden Care Ltd. may update or modify these Terms from time to time to reflect changes in our services, business practices, or legal requirements. The updated Terms will be effective upon posting or upon the date stated in the revised version, whichever is applicable.
Continued use of our services after any changes become effective constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, your sole remedy is to discontinue use of our services.
11. Applicable Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
You agree that any dispute, claim, or proceeding arising out of or relating to these Terms or the services shall be brought exclusively before the courts located in Ontario, Canada, and you irrevocably submit to the jurisdiction of those courts, except where applicable law provides otherwise.

13. Severability Clause
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or other competent authority, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Any unenforceable provision shall be interpreted, where possible, to best reflect the original intent of the parties and to remain consistent with applicable law.
